COMMUNICATIONS TOWER
Pearson v. Newlin Township ZHB, 765 A.2d 1187 (Pa. Commw., January
19, 2001).
In this case, the court was required to determine whether a cellular
communications facility was a radio transmitter where the term was not
defined in the township's ordinance. If considered a radio transmitter
it was permitted by the ordinance as a special exception in an industrial
district. Applying the common usage of the term, the court determined
that the facility was a radio transmitter because it "relays reception
and transmission radio signals between other facilities in the personal
communications grid.
